These Terms & Conditions govern the use of www.thefusionartgallery.com and any purchase of artworks, exhibition participation, events or services offered through it. By using this website or purchasing from us, you agree to these terms. The operator of this website is identified in our Legal Notice.

1. Who we are

The website and its art sales, exhibitions and events in Spain are operated by Johan Grundin (Autónomo, Spain), Spanish VAT/tax ID ESY8358534A, C. Malpica 9, 29002 Málaga, Spain. The Fusion Art Gallery is part of a group of companies; the relevant contracting entity for any service is stated in the applicable agreement or at the point of sale.

2. Products and services

We offer original artworks and prints for sale, paid exhibition participation, art residencies and events, and related marketing and media services for artists. Descriptions, images and prices are provided in good faith. Artworks are unique or limited; slight variations in colour or finish may occur.

3. Prices and payment

All prices are shown in euro (EUR) unless otherwise stated. Where applicable, VAT/IVA is added as indicated at checkout or in the relevant offer. Payment is due at the time of order or as set out in the specific agreement. A place in an exhibition, residency or event is confirmed only once payment has been received.

4. Shipping, delivery and risk

Unless otherwise agreed in writing, the buyer or participating artist is responsible for shipping, customs duties, taxes and insurance relating to artworks. Delivery times are estimates. Risk passes to the buyer on delivery, or on collection where artworks are collected in person.

5. Cancellation and refunds

Consumer rights under applicable EU and Spanish law are respected. For physical goods bought online, eligible consumers may have a statutory right of withdrawal within the legally required period, subject to the exceptions for bespoke or made-to-order items. Fees for exhibition participation, residencies, events and services are generally non-refundable once a place has been confirmed and preparation has begun, except as required by law or as expressly stated in the specific offer. Please review the cancellation terms in each specific offer before paying.

6. Artist services and obligations

Where artists pay to participate in exhibitions, residencies or promotional programmes, the scope of what is included (such as marketing, curation, photography or media production) is described in the relevant offer. We do not guarantee any specific level of sales, audience reach or commercial outcome. Artists retain copyright in their own works and grant us a licence to use images of those works for promotion of the relevant event.

7. Intellectual property

All content on this website, including the brand, logo, text, images and design, is protected by intellectual property rights owned by or licensed to the group and may not be used without prior written permission.

8. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited under applicable law, including statutory consumer rights.

9. Governing law

These terms are governed by Spanish law for activities operated from Spain, without prejudice to any mandatory consumer protection rules of the buyer’s country of residence within the EU.
