TERMS & CONDITIONS
THE FUSION ART GALLERY — GROUP EXHIBITION AGREEMENT (MÁLAGA)
By submitting the payment form and confirming participation, the Artist agrees to the terms below.
1. Parties
Gallery: The Fusion Art Gallery Spain, Calle Malpica 9, 29002 Málaga, Spain. Work under the Swedish The Fusion Art Gallery Spain AB, Org.nr 559255-9776. Contact: Johan Grundin, +34 662 27 29 05.
Artist: The Artist is identified by the legal name and artist name provided in the payment form. If the Artist registers as a company, the company’s VAT/IVA number is provided in the form.
2. The Exhibition
This is a curated group exhibition organised by the Gallery in Málaga. The Gallery selects the artists and works that fit the show. Applying is free. A place in the exhibition is only confirmed once the participation fee has been paid. The number of places is limited and artists are selected on a rolling basis.
3. What the Gallery Provides
The Gallery provides the exhibition space with professional lighting and hanging system, curation and installation, the opening event and collector access, marketing and PR across its channels, and professional photo and video documentation. Sales support is provided before, during and after the exhibition.
4. The Participation Fee and VAT
The participation fee depends on the chosen artwork size and number of works, as listed on the Gallery’s price table. The fee covers full curation, promotion, photo and video documentation, and the use of the exhibition space. All prices are stated excluding VAT.
Private individuals and companies established in Spain pay the fee plus 21% Spanish VAT (IVA). For VAT-registered companies established elsewhere in the EU, VAT is reverse-charged (a valid EU VAT number is required). For companies established outside the EU, no Spanish VAT is charged. The fee is non-refundable once the place has been confirmed, except where the Gallery cancels the exhibition.
5. Who Pays What
The Gallery covers the gallery space, hanging and installation, curation, marketing, and documentation. The Artist covers the participation fee and is responsible for delivering the artwork to and from the Gallery, including all freight, shipping, customs and insurance costs. The Artist also arranges and pays for their own travel and accommodation if they choose to attend in person.
6. Sales and Commission
For any artwork or commision work sold through the exhibition or online, the Gallery retains a 30% commission and the Artist keeps 70% of the sale price. The Gallery pays the Artist their share within 30 days of receiving payment from the buyer. Artworks must be listed at a consistent public price.
7. Artwork, Delivery and Presentation
The Artist provides original works as confirmed in the application. The Artist is responsible for delivering work that is ready to exhibit by the delivery deadline communicated by the Gallery.
Final placement and presentation are decided by the Gallery based on curatorial fit and available space. The Gallery may decline to hang, or reposition, any work for curatorial, technical or safety reasons.
8. Insurance and Liability
The Gallery handles all work with due care but is not liable for damage or loss of artwork during transport. The Artist is responsible for insuring their own work unless otherwise agreed in writing.
9. Intellectual Property
The Artist retains full copyright to all artworks. The Artist grants the Gallery a non-exclusive licence to use images of the submitted works for marketing, promotion and documentation related to the exhibition and the Gallery.
10. Confirmation
By submitting the payment form and paying the participation fee, the Artist confirms they have read and accept this agreement. This agreement is governed by the laws of Spain, and any dispute will be handled in Málaga, Spain.
What Happens after payment
Once your payment is completed and confirmed, you will receive:
- Practical instructions for shipping, delivery deadlines, framing and the hanging system.
- A Dropbox link with official marketing materials for the exhibition. (event visuals, photos, videos, and promotional assets you may use)
- A dedicated artist landing page on our website, presenting you and your work.
- Your selected artworks listed in our online store for extended visibility beyond the exhibition.
